The decision could change the way courts view such cases regionally, or even nationally.Staff Sgt. Ryan Maseth was stationed in Iraq at the Radwaniyah Palace Complex in a barracks with known electrical problems that was maintained by Texas-based Kellogg Brown & Root Services. An underground water pump electrocuted him in 2008. He was 24.Last year, U.S. District Judge Nora Barry Fischer dismissed the case filed by his parents. In her 87-page decision, she found, among other things, that the court could not decide whether KBR was negligent because it is not allowed to pass judgment on military and political decisions under the separation of powers doctrine.Three judges of the 3rd U.S. Circuit Court of Appeals disagreed in a 55-page precedential opinion that is now the law of Pennsylvania, New Jersey and Delaware."Defense contractors do not have independent constitutional authority and are not coordinated branches of government to which we owe deference," the judges wrote. They added that the accusations made by Maseth's parents don't require an evaluation of the military's decisions."I am so relieved and thankful that the 3rd Circuit made the decision that they did, and I am very hopeful and looking forward to the case heading to trial," said Maseth's mother, Cheryl Harris of Cranberry."It's not about money," she added. "It's about contractors really doing the work that they're paid to do, and that's taking care of our soldiers. ... If anything, I'm just hoping for justice for Ryan and all of the soldiers serving in Iraq and Afghanistan."KBR is "disappointed in the court's decision and are reviewing it to determine the appropriate next steps," the company indicated in a written statement. "KBR continues to believe that District Judge Fischer's meticulous analysis of the facts and law, and her dismissal of the suit, was correct. Maseth's parents live in the Pittsburgh area, he lived in Tennessee and KBR is based in Texas."If Pennsylvania law applies, then this case ... may proceed," the judges wrote. The case might be dismissed or go forward with a greatly reduced damages claim, however, if Tennessee or Texas laws apply, the judges continued.KBR had at one point argued that the case should be heard under Iraqi law, but Judge Fischer dismissed that motion.The gist of the appeals court's decision, according to William S. Stickman IV, one of the attorneys for Maseth's parents: "KBR's a company, not a branch of the federal government."That means the firm can't successfully argue that questioning its performance of "routine tasks under its contracts with the military" is equivalent to challenging decisions made in the political realm or in the heat of combat, he said.Mr. Stickman said the 3rd Circuit's decision will be "strongly persuasive" in cases in other areas of the country regarding defense contractors. Source: The Monitor, McAllen, TexasAug.新蒲崗迷你倉 02--MCALLEN -- On paper, Hidalgo County Sheriff Lupe Trevino's political future looks bleak.Judging by past scandals, though, Rio Grande Valley voters appear more likely to express sympathy for Sheriff Trevino than scorn.In December, federal agents charged his youngest son, Mission police Investigator Jonathan Trevino, with stealing cocaine and marijuana from drug traffickers. Along with seven other corrupt cops, Jonathan Trevino recently pleaded guilty to participating in a wide-ranging criminal conspiracy.The saga of Jonathan Trevino and the Panama Unit, the now-infamous narcotics squad staffed with Jonathan's friends, cast a dark shadow over Hidalgo County's smooth talking, politically savvy sheriff. It also erased the euphoria from Sheriff Trevino's landslide victory in November, when he won re-election with 80 percent of the vote.Last month, Sheriff Trevino took tough questions at the Country Omelet restaurant. Asked about the scandal, he compared himself to the faithful partner in a failing marriage."They may live under the same house, share the same bed, share the same finances, but the spouse is always the last one to find out," Sheriff Trevino said. "In this case, I was like that spouse."It's a familiar story.Two years ago, Border Patrol agents arrested Leo Palacios, the son of Pharr Mayor Leopoldo "Polo" Palacios, at the Falfurrias checkpoint with nearly 52 pounds of marijuana. The arrest hardly registered in Pharr."So when that happened to us, you know, we just have to take it like anything else," Mayor Palacios said. "There's nothing we can do, no one we can blame but himself."Ultimately, Mayor Palacios said in a January interview, parents like Sheriff Trevino must let their children make their own choices."And I've known him for many years, and I've known him to be a very respectful and honest person," Mayor Palacios said. "It's unfortunate that this happened to one of his boys, but they shouldn't blame him for that. Nobody should blame Mr. Trevino for what his son did."Starr County Sheriff Rene Fuentes, who took the department's top job after federal agents arrested his predecessor, had a similar experience. His son, Rene Jr., received a 23-month prison sentence for straw purchasing several rifles. The incident doesn't appear to have impacted the career of Sheriff Fuentes, who did not respond to a request for comment Thursday.Generally, the Valley's highest profile lawmen have been judged on their own merits.In 1994, Zapata County Sheriff Romeo Ramirez took bribes from undercover federal agents, according to the Associated Press. A bribery scandal involving a drug trafficker and conjugal visits ended tough-talking Hidalgo County Sheriff Brig Mmini storagermolejo's career the same year.Federal agents arrested Starr County Sheriff Gene Falcon four years later, according to the Associated Press. He, too, took bribes from an informant. And in 2005, Cameron County Sheriff Conrado Cantu was sentenced for extorting drug traffickers and other criminals.Until recently, Sheriff Trevino seemed far above the fray.Several Valley politicians said voters generally hold Sheriff Trevino in high esteem and didn't think the Panama Unit scandal would upend his career."Obviously from a political viewpoint, nothing dealing with the Panama Unit is positive," said state Rep. Terry Canales, D-Edinburg. "When it comes to the sheriff's political future, I wish him the best and I think he is a good guy. I think his heart and his priorities are definitely in the right place."While the scandal will have a negative effect on Sheriff Trevino, the fallout's severity will fall to voters, Canales said.Sheriff Trevino isn't up for re-election until November 2016. By then, the initial Panama Unit cases will likely have faded from memory -- if nothing else emerges.When the steady drip of Panama Unit revelations began to subside in the early summer, Sheriff Trevino's family had another brush with controversy. McAllen police arrested his eldest son, Reserve Deputy John Carlos Trevino, for public intoxication. After telling officers "'Do you know who I am, I'm not (expletive) going with you," he assaulted a jailer, according to police records.The most damaging blows unfolded Thursday, when retired Deputy James Phil "J.P." Flores testified during a federal trial connected to the Panama Unit case. Under oath, Flores told the court that Commander Jose "Joe" Padilla, who reports directly to Sheriff Trevino, forced lawmen to campaign for the sheriff and sell raffle tickets.And the U.S. Attorney's Office told federal District Judge Randy Crane that Padilla was the target of an investigation. Padilla declined to testify. Any investigation into Sheriff Trevino's campaign practices and fundraising would take the controversy to a new level.Sheriff Trevino, who wouldn't comment for this article, appeared unfazed Thursday afternoon, telling KURV-AM host Davis Rankin he felt vindicated by the court testimony."And (he) said 'Everything that we did was behind Sheriff Trevino's back and he knew absolutely nothing of the illegal schemes that we were involved in,'" Sheriff Trevino said, adding that Padilla didn't know about the criminal activity either. Saenz is appealing a judge's dismissal of the state's complaint charging former Harlingen District 3 City Commissioner Kori J. Marra with failing to file a conflict of interest affidavit based on the statute of limitations.Saenz said Thursday that he needs to appeal the dismissal because he doesn't know the underlying reasoning behind Senior Justice David Wellington Chew's decision to dismiss the complaint."I can accept the fact that I lost, but I want to know why I lost so that I can avoid that in the future," Saenz said, although also acknowledging that the 13th Court of Appeals could reverse Chew's rulings.Marra had no comment and her attorney was not immediately available.Chew, a visiting judge assigned to Marra's case in the Cameron County Court-at-Law No. 3, granted in mid-July Marra's application for a pretrial writ of habeas corpus based on the statute of limitations, and her motion to quash and dismiss the complaint against her based on the statute of limitations.The state in March 2011 filed two misdemeanor charges against Marra, alleging conflict of interest and failure to file an affidavit. Saenz was the special prosecutor on the case at the time.A jury in November 2011 acquitted Marra of the first charge and convicted her of the second, sentencing her to 30 days in the county jail, a $500 fine and court costs. The charge was that as a city commissioner, she participated in a vote or decision on a matter that had a special economic effect on a business in downtown Harlingen in which she had a substantial interest without first filing an affidavit stating the nature and extent of her interest in the business.The 13th Court of Appeals overturned her conviction in March this year, and also acquitted her because the state had failed to prove the allegations in the complaint that had been filed against her. For starters, the complaint had carried the wrong文件倉name of her business.Saenz refiled the charge in April this year to include the correct name of the business. Chew's decision to dismiss the complaint came in mid-July.Marra continues under a $10,000 personal recognizance bond.The state has contended that the statute of limitations had been tolled, and had not run its course."I believe that we have very legitimate legal questions on the issue of tolling. I need to know the answers not just for this case, but for other cases in the future," Saenz said. "With all due respect to Judge Chew, he issued an order that basically says she wins and you lose. Having come this far, I want to pursue it. I want the appellate court to say, if I lose, it is because of these reasons. At this point, that is what I'm looking for."Saenz said that if Chew had laid out reasons, he would not be appealing."If there was one way that I could appeal and leave her out of it, believe me I would. If there was some way that I could divorce the two, I would," Saenz said."At this point, my interest is not on the individual Kori Marra, but on the questions," he said."Believe me, it's nothing personal against Mrs. Marra. I respect her. I think she is a wonderful lady. At this point, it is not anything about her," he maintained.Marra lost the office of city commissioner during the years' long ordeal and in 2011 said that she had legal fees already in excess of $18,000.Insofar as how much Marra's prosecution has cost the state, Saenz said: "I've got a lawyer here that does appeals. He is on a salaried position and this is one of the cases that he is working on. Using a Thomas J. Watson Fellowship, Swaim, a freelance documentarian, circumnavigated the globe on cargo ships, taping stories and taking video of the people who work on the ships. She came back with 2.5 tetrabytes of images, sound and text.This summer, she asked nine fellow artists to look at the materials and create their own pieces that reflected movement, space, isolation and other themes of life at sea. The multimedia exhibit "Hold Capacity/Trade Route Stories, Reimagined" is now on view at The Carrack.The exhibit opened officially at Tuesday's artist talk, where several of Swaim's collaborators showed and discussed their work.Several pieces draw inspiration from Swaim's interviews with ship captains, deck hands and other workers. Jenny Morgan's "Intimations of Life at Sea" contains poems inspired from interviews, printed on crumpled sheets of paper that hang from the gallery. A visitor can read the poems, while also listening to some of the recordings with a portable sound player.Nora Weatherby's work includes a book of poems titled "Fifteen Poems from a Year at Sea," inspired by Swaim's journals of her trip. She also created several "poem constellations," mobiles with hanging cards that contain text from navigators and the names of stars. Weatherby compared the mobiles to "poems in motion." She was "inspired by pieces of the transcripts where people were talking about the sky and the water," and wanted to recreate that feeling of looking up into the sky in 迷你倉沙田he way that navigators do.Words also are central to Chris Vitiello's sculpture "The Furies," made up of used windows arranged in the shape of a house. Each window pane contains a statement based on the "hours and hours of audio" he listened to (example: "It's impossible not to find a ship in the middle of the ocean"). In the interviews, "they all eventually talk about home," Vitiello said, and his sculpture reflects that longing among the sailors.Jon O'Neill took some of Swaim's video and created a continuous loop video installation. O'Neill put tape and paper over his film projection lens to give the video of various ship scenes a weathered look. The installation is presented in a small storage closet that, whether intended or not, also evokes the feeling of being in the small, contained space of a ship. Eric Waters also created a video, which viewers can watch on a laptop computer while listening to audio of some of the participants.Using an overhead projector, Jaclyn Bowie demonstrated several of her paper cut-out drawings, some inspired by people in Swaim's archive, others by scenes on board the ships. Bowie said she draws the figures on paper, then cuts out the areas where light will escape. When projected, the images resemble black-and-white drawings.Other contributing artists are Amanda Dahill-Moore, Jonathan Lee and Jacki Huntington.Swaim said she chose to present her work through collaboration because the artists can see it with fresh eyes. 微控制器(MCU)供應商新唐(4919)第2季獲利佳,文件倉繳出季成長超過七成的成績單。展望第3季,雖然音訊應用IC市場需求可望成長,個人電腦(PC)市場要視英特爾和微軟的新品表現而定,目前看來有機會復甦。新唐日前公布第2季和上半年財報,受惠於消費性產品傳統旺季效應發酵,加上32位元微控制器(MCU)出存倉擴增,單季合併營收拉高至19億元,季成長15.98%。新唐的第2季毛利率也拉高到42.24%,比上季成長1.59 個百分點,在營收和毛利率「雙升」下,單季稅後純益有1.14 億元,季成長74.7%,每股稅後純益約0.55元。新唐上半年稅後純益1.8億元,仍比去年同期衰退55.7%,EPS約0.87元。自存倉

The new Bentley Flying Spur gets sharper looks to match a more sybaritic interior.迷你倉新蒲崗 By Samuel EeADD one tastefully executed redesign to a major power upgrade and the fastest ever four-door Bentley is also the British marque's sleekest looking limousine. The new Bentley Flying Spur is lower and wider with crisp new lines and clearly defined edges, thanks to the superformed aluminium front fenders a la the Continental GT coup?m. But like the two-door Bentley, the 5.3-metre-long Flying Spur has a steel monocoque. The platform is similar to the previous car but with a wider front and rear track.Incidentally, the "Continental" suffix has been dropped and the big saloon is now referred to simply as the Flying Spur.Under the hood, the familiar twin-turbo W12 engine continues to drive all four wheels but instead of through the old six-speeder, there is a new eight-speed automatic transmission.The W12 is a 12-cylinder unit in a W configuration and a new engine management system raises output to 625 horses (up 25 hp) and 800 Newton-metres of torque (plus 50 Nm). This 14 per cent improvement in the power-to-weight ratio allows the 2,475 kg (down 50 kg) car to race from zero to 100 kmh in just 4.6 seconds.But the luxury limousine promises to remain as surefooted as ever. The permanent all-wheel-drive has a standard torque split of 40:60 between the front and rear axles, but depending on road conditions, it can send as much as 85 per cent of the torque to the rear wheels or 65 per cent to the front for optimum grip.Inside, the opulent cabin of the Flying Spur features 600 new parts, with only the sun visors, grab handles, armrests and some of the front console and controls carried over from the previous generation.
