McLarty, 28, pleaded guilty Friday in U.S. District Court to a charge of conspiracy to intent to distribute controlled substances, namely heroin and cocaine. U.S. District Court Judge Thomas M. Rose also sentenced McLarty to three years supervised release after he is out of prison.McLarty and Tyler Christian were in a white Chevrolet Impala on April 4 when it pulled into the Beverage Palace on Kingsridge Drive in Miami Twp. Federal Bureau of Investigation officers and other law enforcement surrounded the drive-through with squad cars.Court documents indicate Jermaine C. Coleman Jr., 20, was shot and killed by law enforcement after he allegedly rammed the Impala into two police vehicles while trying to drive out of the drive-through.McLarty's federal sentence will begin after he finishes his five-year sentence for vehicular assault and failure to stop in an unrelated Montgomery County Common Pleas Court case. McLarty, who was sentenced in common pleas court on April 11, will be credited with time served toward his federal sentence. McLarty has been incarcerated since the incident at the Beverage Palace.During Friday's sentencing, Rose told McLarty that, "You haven't respecte迷你倉 the law." Court documents show McLarty has been on probation 10 times for various offenses. While wearing blue Montgomery County Jail clothing, McLarty said he wanted to try to "get myself together," perhaps getting his GED for his benefit and that of his four children.A confidential informant conducted drug transactions with the suspects inside the Impala. While the car was inside the drive-through liquor establishment, FBI personnel from the Southern Ohio Safe Streets Task Force blocked the entrance and exit bays. That's when Coleman, of Dayton, put the car in reverse and rammed into a special agent's vehicle and then accelerated forward to ram into another police vehicle, court documents state. An affidavit said "the driver of the Impala was fatally wounded during the incident."McLarty suffered a gunshot wound to the left shoulder. The statement of facts in court records shows that McLarty "knowingly and intentionally entered into a criminal conspiracy with Tyler J. Christian and another person to possess and distribute cocaine and heroin in the Southern District of Ohio. Christian is scheduled to be sentenced Feb. 7.McLarty could have faced a maximum sentence of 20 years in prison, lifetime supervision and a fine of up to $1,000,000.Copyright: ___ (c)2014 the Dayton Daily News (Dayton, Ohio) Visit the Dayton Daily News (Dayton, Ohio) at .daytondailynews.com Distributed by MCT Information Servicesmini storage

Notre Dame provides contraceptive coverage for now
Source: South Bend Tribune, Ind. Jan. 02--SOUTH BEND -- The University of Notre Dame's insurance plan on Wednesday started providing contraceptive coverage for employees, as required by federal law.But university leaders are continuing with a lawsuit they hope will result in an end to that benefit.Nonprofit organizations with religious affiliations across the country were required to begin providing contraceptive services to employees on Jan. 1 under the Affordable Care Act.Paul Browne, a Notre Dame spokesman, said Thursday that the third-party administrator for the university's insurance program has notified employees that contraceptive coverage is available while the university appeals its court case."As part of an ongoing legal action, however, the program may be terminated once the university's lawsuit on religious liberty grounds against the (Department of Health & Human Services) mandate has worked its way through the courts," Browne said.Notre Dame filed a lawsuit in U.S. District Court for the Northern District of Indiana seeking to be exempted from the requirement based on the university's status as a Catholic institution. On Dec. 20, U.S. District Judge Philip P. Simon denied the university's request for relief from the requirement for contraceptive coverage. But similar cases by other religious-affiliated institutions have produced different results in court. On Dec. 27, district judge Jon E. Deguilio granted injunctions in two other cases, one brought by Grace College & Theological Seminary in Winona Lake, Ind., and Biola University of La Mirada, Calif., and the other by the Catholic Diocese of Fort Wayne-South Bend and several other groups including Franciscan Alliance and University of St. Francis. The differing rulings meant Notre Dame was legally required as of Wednesday to provide the 儲存倉overage, while Grace College, the Diocese of Fort Wayne-South Bend and Franciscan Alliance were not, the Indianapolis Star reported.Meanwhile, Supreme Court Justice Sonia Sotomayor on Tuesday blocked implementation of the section of the law requiring religion-affiliated organizations to provide health insurance for employees that includes birth control, the Associated Press reported. Sotomayor acted on a request from an organization of Catholic nuns in Denver, the Little Sisters of the Poor Home for the Aged. The order's request for an emergency stay had been denied earlier in the day by a federal appeals court. The government must submit papers by 10 a.m. Friday, after which Sotomayor is expected to enter a substantive ruling. Sotomayor's ruling in that case applies only to the litigants in that particular case, not to Notre Dame."However, if she does enter a stay, Notre Dame may ask 7th Circuit to reconsider, as its denial of our stay will be at odds with every other court. If she doesn't enter stay, we continue our appeal as planned," Browne said. The Affordable Care Act exempts churches from providing contraceptive services coverage, but nonprofits such as religious schools, medical facilities and charities only get an accommodation, the Star reported. That means they do not have to provide the coverage option as a part of their employee group plans but must direct workers to a third-party provider that will make the coverage available. Neither the institution nor the employee has to pay for the alternative coverage, with the government picking up the tab in most cases.MFosmoe@SBTinfo.com574-235-6329Twitter: @mfosmoeCopyright: ___ (c)2014 South Bend Tribune (South Bend, Ind.) mini storage

Ratings vs regulators
Cleaning up trash TV and promoting original Chinese entertainment is a monumental task, but regulators are trying.mini storage Xu Wei looks at the latest edicts that went into effect this week. While more regulations to improve China's TV industry go into effect this week, limiting satellite channels to importing only one foreign-format show a year and encouraging more original programming, these augment a raft of controls already in place. Some observers say numerous and specific regulations on content and time slot, which have been issued since 2002, will improve the quality of Chinese television and make it more creative, educational and morally uplifting.Others say they limit diversity and will drive viewers away from TV to the Internet where they can download popular shows and to DVD stores where the shows can be purchased.Limiting wildly popular talent and foreign-format shows is also expected to adversely affect profits. In October 2013, China's broadcast regulator announced the latest rules, a so-called "enhanced version of cutback on TV entertainment." They limit foreign imports by satellite channels to one a year, require that these not be aired in prime time (7:30pm-10pm) during the year when rights are purchased, and stipulate that only one singing talent show, whether Chinese or foreign, be aired during prime time every three months. The regulator, the State Administration of Radio, Film and Television, said the restrictions are aimed at "morality-building."They are part of China's ongoing effort to eliminate vulgar shows and mindless content, ranging from dating shows with risque banter that celebrate money to nonsensical time travel dramas (chuan yue ju 穿越劇).Zhu Hui, a TV producer from Shanghai Media Group, is now working on a reality show about China's grassroots comedy stars. It starts airing in March on Dragon TV and will run for three months.Last year Zhu and her team spent weeks studying creative concepts in TV production in the UK, where she also realized that Chinese TV producers can no longer depend on copying successful foreign formats."It used to be a short-cut to success, but nowadays only a few new formats have turned out to be globally successful," she says. "The regulations will surely push domestic TV producers to find a new way out."Zhu anticipates that in the future two kinds of programs will become popular in China — one that reflects people's lives and emotions, another that broadens their horizons."We will develop a few more programs that break people's stereotypes, expand their vision and stay close to real life," she adds. The restrictions are considered a major challenge to producers since reality shows and singing competitions are among the top earnings on satellite TV.Foreign-format shows, including "The Voice of China" and "Chinese Idol," have been hugely successful, generating revenues of as much as 1 billion yuan (US$165 million) last year. "China's Got Talent" is also popular. In the past two years, more than 30 foreign format-based shows have been aired on satellite TV, but only a few domestic shows have achieved wide popularity.Professor Wu Gang, a TV expert from East China Normal University,儲存says the new policy is a warning against "too much reliance on foreign-format shows and fading creativity in new programs."He says the new policy would provide "a chance for transition and innovation."Ratings, ratings, ratingsNot all TV viewers are enthusiastic.Alex Huang, an IT worker in his 30s, is blunt."The TV industry should adopt the rule of 'the survival of the fittest'," he says."To some extent, programs based on successful foreign formats are just like wolves that prey on goats. Without the pressure of enough wolves, the audience will only get non-nutritious, fast-food shows."As a result of various regulations, many satellite channels have set up their own R&D departments to develop original, homegrown formats. In November, the Sichuan TV held the first China Formats Competition. Experts judged them and analyzed successful Western formats.Pursuit of ratings — the criticism of commercial TV worldwide — is partly responsible for the regulations. They include curbs on star-making shows that flourished after the popularity of "Super Girl" on Hunan Satellite TV in 2005, generally vulgar entertainment programs, and shows with Hong Kong and Taiwan hosts. To receive approval to air shows, TV stations have had to shift from prime time to later slots, change the titles and add charitable goals. For instance, producers of "Chinese Idol" changed the name to "Voice of the Chinese Dream" after President Xi Jinping called on the nation to realize the Chinese Dream.Regulations of China's TV industry issued by the State Administration of Radio, Film and Television2002: The airing of popular Taiwan idol drama "Meteor Garden" is suspended over concern that scenes of violence and high-living by university students would set a bad example.2004: TV shows and series containing scenes of murder and extreme violence are prohibited during prime time.2006: To protect the domestic animation industry, foreign cartoons are prohibited during prime time.2007: Satellite channels are required to broadcast dramas in line with mainstream values during prime time. Vulgar or "obscene" programs about shows such as the hit singing contest "Super Girl" and "My Hero" are not allowed to run for more than six weeks.Talent show rules ban live SMS voting and scenes of teenage fans, mostly girls, writhing and screaming. They ban scenes that might provoke gossip, such as losing contestants weeping.2011: Each week, satellite channels may air no more than two entertainment programs during prime time. Each year, no more than 10 talent shows can be aired on domestic TV."Uplifting," educational and patriotic programs about culture, art, history, geography and charity are encouraged. "Incorrect" social and marriage values such as money worship may not be aired in dating shows. The number and running time of talent, dating, game, talk and reality shows are restricted. The burst of time travel TV dramas was severely criticized, and they fell off.2012: Foreign TV series and films are banned from prime time.2013: Each satellite TV station can buy the rights to only one foreign-made program per year. Every three months, only one singing talent show can be aired in prime time.

School Watch report: Ventura County schools deal with food allergies
Source: Ventura County Star, Calif.self storageJan. 03--Peanut butter and jelly sandwiches are out of the question for Hayden Lynch, a third-grader at Oak Hills School in Oak Park.Being allergic to peanuts and tree nuts means a lot of things are out of the question -- things like potato chips, fried chicken or that box of peppermint cookies a relative sent for the holidays. The latter was produced in a facility that also produces nuts, according to the fine print. The others are fried in peanut oil.A friend's mother once gave Hayden a chocolate granola bar, thinking it was safe. The ingredient list was nut-free. But Hayden read further and found that sentence he's now trained to seek, "May contain traces of nuts.""I came this close," Hayden said, pinching his thumb and finger together. At 8 years old, Hayden is now an expert at reading labels. But he doesn't have to scrutinize them at lunchtime, because his mom packs him a spinach and pepperoni sandwich, his favorite, and he eats it at the peanut-free table at school. Two classmates have severe food allergies, too, and friends who want to eat with Hayden can sit with him as long as they don't bring anything with peanuts. One of every 13 children in the United States has food allergies. Some, like Hayden, could go into anaphylaxis, a potentially fatal reaction, when consuming nuts. Others could develop an allergic reaction just by touching the allergen.President Barack Obama, whose daughter, Malia, has a peanut allergy, signed a law in November that gives grant funding preferences for states to stock up on EpiPen, or injectable epinephrine, at schools. Shaped like a thick pen, the injector delivers medicine that reverses the symptoms of anaphylaxis. The legislation comes on the heels of several high-profile fatalities in Illinois and Virginia, where two students died after ingesting peanuts at school.Karlyn Bock, director of the comprehensive health and prevention program for the Ventura County Office of Education, said having epinephrine available whenever possible is a good idea."You never know when someone's going to have a serious allergic reaction to something that was previously undiagnosed," Bock said."If you look at how many severe anaphylactic reactions occur during a school day, it's rare. It's very, very rare. But you only need one case."THE $1 MILLION QUESTIONThe number of people with severe food allergies has been increasing in recent years, particularly among children. According to the Food Allergy Research & Education nonprofit group, the number of U.S. children with peanut allergies tripled from 1997 to 2008.Sheila Raives of the Ventura Unified School District's Health Services department, said allergies as a whole have been increasing in the past 10 to 15 years. She knew of a school nurse who had never given an EpiPen shot in the 17 years of her career, then had to give it four times in one year, although one was for a bee sting."Peanuts get a lot of press, but there are also gluten allergies, eggs and other things ... and students with diabetes," Raives said. "We're educating parents to move them away from bringing food items" for classes. For birthdays and special occasions, Raives said, parents can bring pencils, for example, instead of food. There is no cure for food allergies and no clear answer on why the numbers are increasing. Some people think doctors are testing and identifying allergies more than before. Others wonder if it's due to the abundance of processed foods."I think that's the $1 million question," Raives said.In Ventura County, an estimated 5 percent of students in public schools, or 1 out of 20 children, have some form of food allergy. The figure is an estimate because some school districts do not track allergies among older students and some do not have data for mild 迷利倉llergies. Most EpiPen at schools is provided by the student's family and kept in the nurse's office or classrooms. Students with severe allergies might carry an EpiPen with them.Ginger Riggins, the nurse for the Santa Paula Unified School District, said some students have an EpiPen at home but can't afford to have one at school."It poses a problem. If they're on a field trip, it could become a major issue," Riggins said.TRAINING IS KEYRiggins said the new legislation makes sense, but she wonders whether there are resources to train school staff if EpiPen becomes more widely available."If somebody jumps the gun or doesn't know why they're being used or how to use them ... that's the only thing that scares me," Riggins said. Many school staff members are trained every year on the use of EpiPen. In October, all teachers, teacher aides, yard duty supervisors, office managers and clerks in the Somis Union School District were trained to administer an EpiPen.Superintendent Colleen Robertson said staff members practiced giving themselves a shot in the leg with an injector that did not have a needle. The hope is that an EpiPen won't have to be used, but when needed, a trained adult is nearby. When Hayden started kindergarten, his mother, Micheline Lynch, told everybody who worked at the school about his allergies."I did not want to use that EpiPen," she said.Lynch remembers very well the first and only time Hayden got an epinephrine shot. "He was 2 and we found out the hard way," she said.Hayden had eaten peanut butter. His lips swelled up, and a nasty rash quickly followed. Without an EpiPen, all Lynch could do was dial 911 and wait."It seemed like an eternity," Lynch remembered.DISTRICT POLICIES VARYToday, Lynch said, she is assured that Hayden will be safe when he goes to school. All schools in the Oak Park Unified School District have peanut-free tables monitored by campus supervisors. The Pleasant Valley School District is peanut-free, meaning cafeterias do not serve anything with peanuts or ingredients produced in a facility that process peanuts. The Pleasant Valley and Somis Union school districts have switched to sunflower butter. In the Simi Valley Unified School District, peanut butter and jelly sandwiches are served every day except for kindergartners during the first month of the school year, when teachers are still gathering food allergy information from parents.Longtime teachers say they remember a time when the biggest health concern was a few students in class with asthma. Today, food allergies have become part of the lesson plan. Young students are taught that everybody is different. Some children can run fast, some can't. Some can eat peanuts, others can't."The kids really start policing each other," said Carol Bjordahl, director of students services for Pleasant Valley. "Our goal is that kids can grow up and become independent. We're empowering them to say, 'You eat peanut butter, but I cannot be around that.' "Hayden is careful about what he can and cannot eat. But every once in a while, he'll ask his mom to bend the rules for nut-free products that might have been processed near nuts.Sometimes Hayden wonders what peanut butter tastes like. Sometimes he wonders if he'll ever outgrow his allergies. For Lynch, having a son with food allergies means taking a bit longer in the grocery store reading labels."It's easy now," she said. "At first I thought it was the end of the world."TO LEARN MORE:.foodallergy.org.cde.ca.gov/ls/he/hn/epiadmin.asp.cdc.gov/healthyyouth/foodallergies.niaid.nih.gov/topics/foodallergyStaff writer Jean Cowden Moore contributed to this report.Copyright: ___ (c)2014 Ventura County Star (Camarillo, Calif.)
