作者：石述思奇虎360與騰訊的“3Q大戰”已經整整持續了兩年半，儲存目前已經無限接近塵埃落定。目前，雙方種種糾纏著江湖恩怨的說辭，已經激不起媒體太多興趣。也許儘快謝幕對所有人都是一種解脫。從目前的情形判斷，無論官司的勝負，騰訊和360都不是真正意義的輸家。借助法庭上的狼煙，兩家公司都賺足眼球，在注意力經濟當道的互聯網世界，這樣的廣告效應遠遠超越訴訟的成本，尤其是後起之秀360總裁周鴻禕絲毫不掩飾這點。而消費者最終淪為綁在商業戰車的可憐籌碼，卻徒呼奈何。無論是互聯網市場管理，還是IT業不正當競爭，目前根本沒有一部完整意義的行業法規。而修改後的消費者權益保護法也對類似競爭引發的侵權缺乏明確條款。尤其是目前我國在軟件兼容方面的立法不完善，必將成為未來宣判的難點。這說明，近些年即使互聯網已經成為公�日常生活工作關鍵的工具，網民數量逼近6億，而相關的立法工作嚴重滯後，為企業惡性競爭，危及消費者利益提供了溫床。更令人費解的是，3Q大戰如火如荼地持續兩年多時間，不少律師、法學界專家關迷你倉完善立法的意見建議不絕於耳，卻始終未引起相關部門高度重視。2010年11月21日，在3Q大戰白熱化，並引發消費者�怒的情況下，工信部才通報批評騰訊和360，並要求雙方5日內向社會公開道歉。同時稱下一步將會同有關部門對兩公司涉嫌違反相關法律規定的行為進行調查處理。但這沒有阻止騰訊最終起訴360扣扣保鏢不正當競爭，並于2011年9月在廣東省高院立案。還有一個輸家是互聯網相關行業協會。這個關鍵的行業自律組織在行政化的窠臼下，往往面臨權力和利益雙重綁架，很難真正有效地發揮其規範企業競爭、推動市場秩序完善、維護消費者合法權益的作用。正因為這重重關隘的失守，3Q大戰如脫�野馬，最終將官司打到高法，期間耗費的社會成本、司法成本和公�利益成本難以估量。無論高法最終如何判決，都將影響未來我國互聯網的立法方向，並期待能從真正維護消費者權益、維護正常市場競爭秩序的角度，真正依法厘清政府、企業和社會的邊界，推動整個行業監管體制的完善。是時候亡羊補牢了。（文章來源：中國經營網，作者系資深媒體人）self storage
