New rules help keep violent incidents and confrontations in check, Tang Yue reports in Beijing. For years, journalist Chen Baocheng wrote about other people’s lives, covering stories on the judiciary and law enforcement issues. However, the 34-year-old recently found himself in the headlines. In August, the Beijing reporter was briefly detained for allegedly holding a man against his will for a day during a protest over forced home demolitions in Chen’s hometown of Pingdu, Shandong province. Police claimed that Chen and a number of his fellow villagers had poured several bottles of gasoline over the man, a construction worker, and threatened to set him on fire. Chen was formally arrested last month, but as yet it is unclear whether he will face trial. The story became a hot topic on Chinese social media. One observer, Li Gang, was more interested than the average news follower because the case reminded him of his own experiences. Li, who is the same age as Chen, is also a reporter, but in Shanghai. Three years ago, his family home in Kaiyuan, Liaoning province, was demolished and the adjoining farmland was reclaimed by the local government without the family’s consent. The move followed a three-year stalemate over compensation, Li said. Society: ‘Nail houses’ prove a snag to urbanization process “One day they (the demolition team) just broke in early in the morning and drove my mother and my grandfather away from the house. I was in Shanghai and the news worried me greatly,” he said. “The government held my mother and grandfather in a hotel for a couple of days, until the officials were certain they wouldn’t do anything extreme, such as setting themselves on fire.” When he heard the news, Li immediately joined a group of fellow villagers and traveled to a number of petition offices in Beijing. His mother went to Shenyang, the provincial capital, and moved in with her daughter and son-in-law, while his grandfather went to a nursing home, where he died last year at the age of 92. Age of urbanization The large-scale demolition of housing started in the early 1990s. Initially, old and shabby city dwellings were targeted, but as China embraced the age of rapid urbanization, the policy was soon expanded to include rural areas. The process has reshaped the image of the country and the lives of its people, cleaning up the urban landscape and improving housing conditions for hundreds of millions. However, in a country where local governments’ dependency on land sales, house prices and people’s awareness of their rights are all on the increase, the practice has never run smoothly. Land sales have become an increasingly important source of revenue for local governments, rising from 9.19 percent in 1999 to 63.7 percent in 2011, according to the China Land and Resources Yearbook. At the same time, forced demolitions have become a major source of social conflict; more than 22 percent of the mass incidents seen in China last year resulted from land acquisition and forced demolition, according to Legal Daily. In 2009, a report by China News Service claimed that 40 percent of the cases received by the State Bureau for Letters and Calls, also known as the National Petition Office, from 2003-06 were related to forced demolitions. The practice has given rise to an emerging phenomenon and coined a new phrase, the “nail house”, which refers to people who refuse to move, for whatever reason, and whose houses stand out in an otherwise deserted and barren landscape. Among a number of high-profile nail house cases, that of Yang Wu, a local martial arts champion, and his restaurateur wife Wu Ping, was dubbed “the coolest” by the media. The couple, from the central municipality of Chongqing, reoccupied their home and flew the national flag from the roof, even after the developers cut off their power and water supplies, and excavated a 10-meter-deep pit around the house. The couple frequently gave interviews and issued news releases to generate publicity, before finally settling with the developers in 2007 after a three-year stalemate. New regulations However, not every property dispute is resolved without injury or, sometimes, even death. In one notable case, Tang Fuzhen, 47, a resident of Chengdu, the capital of Southwest China’s Sichuan province, committed suicide in 2009 by setting herself on fire to protest the forced demolition of her house. Tang’s story prompted five law professors at Peking University to submit an open letter to the National People’s Congress, the country’s top legislative body, urging revision of the demolition regulations, a move that attracted great public attention. Under the law at the time, which came into force in 2001, local governments were allowed to enforce demolitions at their own will, but in 2011, new regulations were issued to put an end to the practice. The new law also made it illegal for developers or governments to cut water and power supplies during the relocation process. Moreover, forced demolitions could only be carried out if the developers obtained a court order allowing them to do so. Since being enacted, the 2011 regulations have helped reduce the number of conflicts resulting from demolitions in the cities, according to lawyers. “Local governments are more cautious in their behavior and cases of forced demolition in cities have declined,” said Yang Zaiming, a well-known lawyer who specializes in demolition lawsuits. However, problems have continued in the countryside because most farmers are not fully aware of their legal rights under the current law, he said. “Farmers are less clued-up in terms of the legal aspects than urban citizens and they are more afraid of the government if conflicts arise,” he added. “Sometimes, it is true you can see the farmers have signed the consent form, but often they do so as a result of continual intimidation and harassment.” Moreover, some forced demolitions are carried out by gangs of workers employed by local governments, rat迷你倉er than by full-time government staff, according to an annual report on demolition by Wang Cailiang, another lawyer who specializes in demolition cases. The rural regulations have set a ceiling on the level of compensation that can be paid, stating that it cannot exceed 30 times the average annual production value of the land in the three years prior to acquisition. “In most cases, it is no more than 60,000 yuan ($9,800) per mu (a Chinese measurement equivalent to 0.06667 of a hectare), which translates to less than 100 yuan per square meter. It’s no surprise that the people are unhappy,” said Jiang Ming’an, one of the law professors who wrote the open letter in 2009. The issue has also caught the attention of the central government. Early last year, then Premier Wen Jiabao noted that although land is the farmers’ most important possession, their rights have not been fully protected. Wen said the law needs to be revised, but no clear schedule has yet been revealed. Tao Zhen, an expert on public policy with the Shanghai Administration Institute, argued that the lives of farmers after losing their land should also be taken into consideration. “It has been a notable problem that many farmers become jobless and have no access to social welfare once their land has been acquired,” he wrote in an article published in Study Times, the Communist Party of China’s leading theoretical journal. He urged greater transparency in the land-acquisition process and suggested an overhaul of the system of employment training. Other side of the coin The local governments have also put forward their side of the story. In a recent interview with Xinhua News Agency, Geng Yanbo, the mayor of Taiyuan city, the capital of Shanxi province, said: “The toleration of nail houses is unfair to most people. If those who ask for an unreasonable amount of compensation benefit in the end, social order will be disrupted.” Wang Cailiang’s report acknowledged that some farmers push for a higher level of compensation by extending their houses shortly before demolition is carried out. “Learning from the local government, they know it is easier to get rich by planting houses than crops,” he wrote. Wang’s assertion was backed up by an official who worked in the relocation department of Yunnan province from 2004-06, and who spoke to China Daily on condition of anonymity. “I’ve seen some farmers add two floors to their house just a few days prior to demolition,” said lawyer Yang, who acknowledged that while some people manage to obtain more compensation than they are entitled to, the number is far lower than those whose payout is less than they legally deserve. “There are accurate reports of some farmers becoming millionaires or even richer overnight through demolition compensation, but that only really happens in the suburbs of large cities such as Beijing and Shanghai. It’s not the case for most farmers,” he said. Li Gang’s family was initially offered 130,000 yuan as compensation for the loss of their 60-square-meter house and the acquisition of approximately 2 mu of farmland (roughly 1,333 sq m). However, in September, the family finally accepted compensation of approximately 440,000 yuan, after a three-year battle, during which Li’s mother traveled to Beijing a dozen times to petition various officials. “It’s not that we’re greedy. It’s just really unfair. The houses that now occupy our old village sell for thousands of yuan per square meter, but most of the villagers received so little for their loss,” said Li. Contact the writer at tangyue@chinadaily.com.cn Yang Wanli and Zhao Xu contributed to this story. Farmers are less clued-up in terms of the legal aspects than urban citizens and they are more afraid of the government if conflicts arise. Sometimes, it is true you can see the farmers have signed the consent form, but often they do so as a result of continual intimidation and harassment.” Yang Zaiming lawyer who specializes in demolition lawsuits “The toleration of nail houses is unfair to most people. If those who ask for an unreasonable amount of compensation benefit in the end, social order will be disrupted.” Geng Yanbo Mayor of Taiyuan, Shanxi province timeline • 1991: The first law relating to demolitions in cities is enacted. It mainly targets old and shabby dwellings in a bid to improve housing conditions and leads to very little conflict. • 1994: A new policy on urban housing reform that encourages real estate development is declared. Real estate developers, instead of local governments and “work units”, become increasingly important providers of housing. Profound tax reforms are introduced in favor of the central government, which now shares 75 percent of value-added tax and 60 percent of corporate income tax. Local governments begin to increasingly rely on revenue from land sales. • 2001: The regulations relating to demolitions in cities are revised, but still allow developers to carry out forced demolitions. Local governments are authorized to enforce demolitions. • 2007: The Property Law is enacted. It says: “It is necessary to make compensation for demolishment and relocation according to the law and to safeguard the legitimate rights and interests of the owners of the properties expropriated; as for the expropriation of individual residential homes, it is necessary to safeguard the housing conditions of the owners of the houses expropriated.” • 2011: The urban demolition regulations are revised again, forbidding forced demolitions in the cities by governments. If the government cannot reach agreement with homeowners regarding expropriation or compensation, demolition can only be carried out after review and approval by a court. The measure also outlaws the illegal cutting off of water and power supplies during the period of relocation. It also states that compensation for expropriated homes in urban areas should not be lower than the sum of the market price of similar properties at the time of expropriation.— Tang Yue self storage

Source: Albuquerque Journal, N.mini storageM.Oct. 13--On a recent Saturday in September, Chris and Antoinette Garcia were belly up to the sales bar at Vapor Space in Albuquerque for their latest nicotine fix.The couple began using electronic cigarettes this summer to quit smoking, something neither had been able to do previously with nicotine patches or gum.But after two months of inhaling nicotine-laced vapor through devices they bought at Vapor Space, they both now swear by e-cigs as the holy grail for smokers looking to quit the habit."I've smoked a pack a day of cigarettes since I was a kid," said Chris, 32. "But now I don't smoke. I haven't had one cigarette since two months ago."Antoinette, 25, said nothing else worked for her until now."I tried the nicotine patch, and I ended up smoking even while I used it," she said. "But now I haven't smoked since we started with the e-cigarettes. That's the first time in eleven years."Like the Garcias, thousands of consumers in Albuquerque and elsewhere are starting to embrace e-cigarette devices, which deliver small amounts of nicotine to users' lungs as part of a flavored vapor that people inhale.Their growing popularity is generating a new thriving industry at the local and national levels, with hundreds of varieties of e-cigarettes now available at nearly all smoke shops, convenience stores and retail outlets, and at specialty stores such as Vapor Space. But as consumer demand expands and e-cigarette businesses gain ground, debate is becoming more intense over the alleged benefits and the potential dangers of inhaling nicotine and other ingredients in the vapors. That debate may take center stage in late October, when the U.S. Food and Drug Administration is expected to release its first proposed regulations for e-cigarette products."With public awareness now widespread, the industry is no longer really in its infancy, but rather it's out of its diapers and in crescendo," said Freddy Olsen, owner of Vapor Space at the corner of Montgomery and Wyoming boulevards. "But the question of regulation will certainly help shape how stores like ours move forward. Right now, the industry is totally unregulated."Health concernsIndustry skeptics, which include the American Lung Association and the World Health Organization, say not enough is known about the short- and long-term effects of inhaling nicotine, nor the impact of some of the ingredients used to make the vapor and flavored liquids. That includes propylene glycol, which contributes to what smokers call the "throat hit," or harshness felt when puffing on an e-cig. It also includes vegetable glycerin and flavoring. But industry advocates counter that no study to date has shown e-cigarettes contain any levels of ingredients or toxins harmful to humans. In addition, they eliminate all the toxic chemicals that come from smoking regular cigarettes, such as tar and carbon monoxide, most of which is created when tobacco and filler products are burned. And, while nicotine is highly addictive, the e-liquids used in electronic cigarettes contain only a fraction of the nicotine levels found in tobacco products."I tell customers that I can't say outright that it's harmless, but I can say in good conscience that it's 1,000 times less harmful than smoking," Olsen said.Despite the uncertainties, e-cigarette use is growing rapidly. Early this year, the Centers for Disease Control and Prevention reported that one in five adult U.S. smokers, or 21 percent, have either tried or now use e-cigs. That's up from 10 percent in 2010.Sales are exploding. A new report by analysts from Wells Fargo projects the market will reach $1 billion this year, up from $500 million in 2012 and just $20 million in 2008.Most major tobacco companies are in the market, such as Lorillard and the Altria Group Inc., parent company of the nation's largest cigarette maker Philip Morris USA.And some big new players are capturing a major slice of sales, such as NJOY, an Arizona-based e-cigarette firm that distributes its product in about 75,000 convenience and retail outlets in the U.S., said NJOY President and CEO Craig Weiss."We're in all 50 states in stores like 7-11, Circle K, Wal-Mart and Costco," Weiss told the Journal . "Most estimates now put e-cigarette penetration at between 1 and 2 percent of the market, so the potential is still quite enormous. We believe it's an $80 (billion) to $90 billion market in the U.S."Parallel marketsBut it's real儲存y two parallel markets that are emerging. On the one hand are the traditional tobacco firms and companies like NJOY that designed their products to look as much as possible like real cigarettes to appeal to smokers. Those are disposable devices that sell for about $9 per unit and last for about 300 to 400 puffs before consumers throw them away."Our product has a paper feel, a soft tip and a flip-top package, because those things remind (users) of what's familiar to them as smokers," Weiss said.In contrast, specialty stores like Vapor Space sell a totally different product with no resemblance to a regular cigarette. Rather, they look like very large pens or small piccolos. They have three screw-in parts that include a rechargeable battery, an atomizer and a tiny tank for e-liquids.The user hits a button on the battery to release a small voltage. That heats a coil in the atomizer, which has a wick touching it. As liquid drips onto the wick and the coil heats up, it turns the liquid to vapor, which users then inhale through a mouth spout. The vapor sticks range from starting devices that cost as little as $30 to $40 to high-quality ones that can cost $150 or more. After that, users buy vials of e-liquids to refill the tanks. They cost between $5 and $10 in Albuquerque, depending on the store and e-juice quality, and up to $15 to $20 in other markets.Olsen and other vapor store owners say their product creates a totally different experience for smokers compared to standard e-cigarettes. For one thing, because the e-liquids are mixed on site, store operators can raise or reduce the amount of nicotine in the juices, allowing smokers to slowly lower their nicotine intake."There isn't always nicotine in the liquids," Olsen said. "People ask for different levels, and we mix it up to 24 milligrams per milliliter. Some just get flavored vapor with no nicotine and use it for a smoking sensation, while others wean themselves down over time to get to zero."That's very different from standard e-cigarettes sold by the tobacco companies, said Vapor Space store manager Luke Merry."Those guys offer a metered dose of nicotine all the time," Merry said.In addition, vapor stores offer scores of e-liquid flavors that they mix on site to cater to individual tastes of consumers, and to make the vaping experience as much about smoking flavored vapors as it is about satisfying a nicotine addiction."We have about 100 base flavors," Merry said. "They range from key lime pie and chocolate after-dinner mint to lemon green tea and standard tobacco blends."Some stores specialize more in the vaping devices, while others concentrate on the liquids. Betamorph e-cigs, for example, which opened in July at 2000 Carlisle NE, specializes in e-juices, said co-owner Andrea Glass.Apart from offering many different flavors, Betamorph customizes ingredients to better fit individual needs."A very small percent of the population is sensitive to propylene glycol," Glass said. "It's not a serious or dangerous allergy, it just causes discomfort, like a stomach ache, so for some customers we mix e-liquids that are 100 percent vegetable glycerin and zero PG."About 10 vapor stores now operate in Albuquerque, but the number is growing. In addition, many smoke shops now have sections devoted to vaping devices and e-liquid sales.Apart from the nicotine crutch to quit smoking, e-cigarette users say they're saving a lot of money. After the one-time investment in a vaping device, the user just buys vials of e-liquids, which can last up to two weeks, depending on the smoker."When my wife and I were smoking cigarettes, we were spending more than $40 a week," Chris Garcia said. "Now we just spend $5 every two weeks for each of us."Store owners say they're driven by the desire to spread what they believe are the benefits of e-smoking."I got into the business through pure enthusiasm," said Olsen, who smoked for 25 years before quitting through vaping. "It's something totally new and life changing."Glass said she wants to help people."We're not in it to get rich," said Glass, a first-time business owner who opened Betamorph with her partner, Dylan James. "It's a new product that people are just learning about. I see huge potential for it to save millions of lives."Copyright: ___ (c)2013 the Albuquerque Journal (Albuquerque, N.M.)

記者在譯林出版社處得知,譯林出版社確認已簽下其七部重要作品的版權協議,分別是《太多的歡樂》(Too Much Happiness)、《快樂影子舞》(Dance of the Happy Shades)、《恨、友誼、追求、愛、婚姻》(Hateship,Friendship,Courtship,Loveshipmini storageMarriage)、《少女和女人的生活》(Lives of Girls and Women)、《公開的秘密》(Open Secrets Stories)、《一個善良女子的愛》(The Love of a Good Woman)、《愛的進程》(The Progress of Love),囊括了芒羅早中晚各個時期最具代表性的短篇小說作品。
